SFL Footage Agreement

WHEREAS THE SCOTTISH FOOTBALL LEAGUE is the owner of fixtures, the copyright in which is vested in The Scottish Football League, and the Club wishes to reproduce footage of the matches;

IT IS AGREED as follows:


1. Subject to the terms of this Agreement, permission is granted by The Scottish Football League for Season 2008/2009 to the Club to film its home and away matches, for training and coaching purposes.

2. The Club may however use footage filmed for training and coaching purposes and footage obtained by the Club in terms of paragraph 11 hereof (hereinafter together called “the Footage”) for display on club websites only and for no other commercial purpose whatsoever. For season 2008/2009, or until further notice, where the Club wishes to film footage of away matches, the written approval of their opponents must be obtained prior to the match.

3. Copyright in any of the Footage taken is hereby assigned to The Scottish Football League.

4. The Club undertakes that all Footage shall have the legend “Match Footage © The Scottish Football League, reproduced by permission.”

5. Any Footage shown will be for a maximum duration of three minutes per match and displayed not less than 24 hours after the end of the match.

6. The Club shall ensure that at all times competitions shall be referred to by their correct titles giving credit to the sponsors, e.g. The Co-operative Insurance Cup.

7. Any Footage must only be displayed on the Club's official website and not on any supporter controlled or other independent website. In addition, clubs are not permitted to provide a link to any other independent websites (e.g. Google, You Tube etc.) which will enable these websites to display SFL copyrighted footage.

8. The use of still pictures from Footage is also permitted provided the still pictures are not combined to form any sort of moving image.

9. Display of any Footage of controversial incidents which may involve disciplinary action by match officials or the football authorities is strictly prohibited.

10. Any Footage shown must observe acceptable common decency and no material must be shown which could reasonably be regarded as derogatory or offensive to third parties.

11. If the Club wishes to access Footage of material filmed under an existing contract between a broadcaster and The Scottish Football League the Club must apply in writing to The Scottish Football League for permission to obtain the Footage from the broadcaster and pay any facility fee directly to the broadcaster.

12. In the event of any infringement of the terms of this Agreement by the Club The Scottish Football League shall give the Club written notice of such infringement. In the event of the Club failing to rectify such infringement within a period of 14 days from the date of such notice The Scottish Football League reserves the right to terminate this Agreement forthwith on the expiry of said period of 14 days. In the event of such termination the Club shall forthwith cease to display the Footage on the Club websites.

13. It is a condition of this consent that the Club provides The Scottish Football League with information on the number of unique visitors to the pages of your club's website which features this Footage. This information must be submitted to The Scottish Football League by e-mail to info@scottishfootballleague.com at the end of each month.

14. The club will provide free of charge to The Scottish Football League upon request, a master tape of broadcast quality encompassing the complete filmed action of all matches played under the jurisdiction of The Scottish Football League.

15. The Club will not be entitled to transfer or sub-license its rights under this Agreement.

16. This Agreement shall be governed by Scottish law and subject to the exclusive jurisdiction of the Scottish courts.
